The City Council will hold a special meeting at Commerce City Hall, 1119 Alamo Street, Commerce, Texas at 6:30 p.m. on July 1, 2008.

Executive Session – To consult with attorney regarding pending or contemplated litigation, settlement offers, or matters deemed subject to the Code of Professional Responsibility of the State Bar of Texas, in accordance with V.T.C.A. Government Code 551.071.

The City Council will hold a regular scheduled meeting at Commerce City Hall , 1119 Alamo Street , Commerce , Texas at 7:00 p.m. on July 1, 2008.

            a.   Approval of Minutes:

                        City Council Regular Meeting – June 17, 2008

                        City Council Special Meeting – June 21, 2008

                        Hunt County Appraisal District Meeting – June 12, 2008

                        Commerce Economic Development Corporation Meeting – June 18, 2008

b.         Consideration of Motion authorizing appointment to the Planning and Zoning Commission.

c.         Consideration of Resolution authorizing Fuel Provider Agreement with Texas A&M University-Commerce.

d.         Consideration of Resolution providing approval for the Spin-Off of Time Warner Cable Inc.

4.         Presentation to City Council by members of the Public.  (To be conducted as close to 7:15 p.m. as possible with a three-minute limit per person.  Public Comments will cease at 7:30 p.m.  This period is reserved for citizens to discuss items not on the listed agenda.  The response to Public Comments will be limited to:  1) A statement of fact or policy; 2) Direction to take up the issue with a city staff member; 3) An offer to place the item on a future Council Agenda.

5.         Consideration of Resolution authorizing employment contract with new City Manager.

6.         Presentation and possible action taken regarding possible application for new ORCA Grant.

7.         Consideration of Resolution for submission of a grant application to the Texas Department of Housing and Community Affairs HOME Program for Owner-Occupied Housing Assistance.

8.         Public Hearing and consideration of Resolution authorizing Grant Agreement with the United States Department of Agriculture Rural Housing Service.

9.         Consideration of Resolution requesting financial assistance from the Texas Water Development Board with respect to improvements for the City’s sewer system.

10.       Consideration of Resolution engaging engineering, legal and financial consultants to assist the City in obtaining funding from the Texas Water Development Board for improvements to the City’s sewer system.

11.       Discussion and possible action taken regarding settlement of pending litigation, United States District Court, Northern District of Texas, Dallas Division, John Doe #7 Plaintiff vs. City of Commerce, Texas, Sheryl Zelhart, Richard Hill, Anthony Henry, John Sands, Billie Biggerstaff and William J. Shipp, Jr. Defendants, Civil Action 3-08CV0324-M.

If during the course of the meeting, any discussion of any item on the agenda should be held in closed session, the Council will convene in such executive or closed session in accordance with the following:  1) VTCA Government Code 551.071 - Consultations with legal counsel concerning pending or threatened litigation or matters where counsel’s duty to the City conflicts with the Open Meetings Act;  2) VTCA Government Code 551.072 - Deliberations regarding the purchase, sale, lease or exchange of real property;  3) VTCA Government Code 551.073 - Deliberations regarding prospective gifts or donations;  4) VTCA Government Code 551.074 - Deliberations regarding personnel of the City; and 5)VTCA Government Code 551.076 -  Deliberations regarding the deployment of security devices or the implementation of security policy.
